MARCH HARE LICENSE AGREEMENT

Please read this March Hare license agreement (called the EULA) carefully. Your use of the software or any related documentation (called the Software) indicates your acceptance of the following terms and conditions. If you do not agree to these terms and conditions, you may not install or use the Software. 

Demo Software is made available without charge in order to allow you to evaluate the Software. We encourage your feedback and suggestions. 


END-USER LICENSE AGREEMENT FOR 
MARCH HARE PTY LTD SOFTWARE


NOTICE TO USER:
THIS IS A CONTRACT.  BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
If you do not agree to the terms of this End User License Agreement (EULA), do not install, copy, or otherwise use the SOFTWARE PRODUCT; you may, however, return it to your place of purchase for a full refund. 

SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold. NOTE: The terms of a printed, paper EULA which may accompany the SOFTWARE PRODUCT supersede the terms of any on-screen EULA found within the SOFTWARE PRODUCT.

1.	LICENSE TO USE SOFTWARE PRODUCT. 
1.1	General License Grant. Except where restrictions exist elsewhere in this EULA, March Hare Pty Ltd grants to you as an individual, a personal, nonexclusive license to make and use copies of the SOFTWARE PRODUCT. 
1.1.1	License Grant for Form ToolKit (also known as UD6 Option Pack). March Hare Pty Ltd grants to you as an individual, a personal, nonexclusive license to make and use copies of the Form ToolKit (also known as UD6 Option Pack) for the sole purposes of developing, maintaining, and analyzing Uniface source code.
1.1.2	License Grant for UD7 Driver. March Hare Pty Ltd grants to you as an individual, a personal, nonexclusive license to make and use copies of the UD7 driver for the sole purposes of processing or storing data owned by you.
1.1.3	License Grant for UD8 Driver. March Hare Pty Ltd grants to you as an individual, a personal, nonexclusive license to make and use copies of the UD8 driver for the sole purposes of processing or storing data owned by you.
1.1.4	License Grant for UD5 Driver, and MH3GLs Library. March Hare Pty Ltd grants to you as an individual, a personal, nonexclusive license to make and use copies of the UD5 driver and MH3GLs Library for the sole purposes of processing or storing data owned by you.
1.1.5	License Grant for all DEMO software. March Hare Pty Ltd grants to you as an individual, a personal, nonexclusive license to make and use copies of the DEMO SOFTWARE for the sole purpose of evaluation.  Use of the DEMO SOFTWARE for any commercial purpose is not granted.
1.1.6	License Grant for all GNU software. GNU software is free software; you can redistribute it and/or modify it under the terms of the GNU General Public License as published by the Free Software Foundation.  GNU software is distributed in the hope that it will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.  See the GNU Public License for more details.
1.1.7	License Grant for all SUN software. See the Sun Microsystems, Inc. Binary Code License Agreement (reproduced below) for more details.
1.1.8	You may install copies of the SOFTWARE PRODUCT only on a single server computer, or multiple client computers covered by a single Uniface License number and as prescribed on the invoice from March Hare Pty Ltd.
1.1.9	You may install copies of the SOFTWARE PRODUCT provided that only individuals from the entity that purchased the SOFTWARE PRODUCT or designated contractors use it, in the manner provided above.
1.2	Documentation: This EULA grants you, as an entity a personal, nonexclusive license to make and use an unlimited number of copies of any documentation, provided that such copies shall be used only for personal purposes and are not to be republished or distributed (either in hard copy or electronic form).
1.3	Storage/Network Use. You may also store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to install or run the SOFTWARE PRODUCT on computers used by a licensed end user in accordance with Section 1.1.  A single license for the SOFTWARE PRODUCT may not be shared or used concurrently by other end users.
1.4	LIMITED software:  This EULA grants you, as an entity a personal, nonexclusive license to make and use the SOFTWARE PRODUCT in conjunction with the licensed VAR's supplied software or services.  This software may NOT be used or modified for any other purpose by the end user.

2.	SOURCE CODE-ADDITIONAL LICENSE RIGHTS.
2.1	Personal or Organisational Use of Source Code. March Hare Pty Ltd grants you the right to use and modify the source code for your personal use or use within your organisation, complying with Section 1 above.  
2.2	March Hare Pty Ltd does not give you the right to reproduce, copy or sell any portion of the source code (in part or whole) whether in original purchase form or upgraded (by yourselves) either in it's entirety or as an inclusion in another product.

3.	DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
3.1	Not For Resale Software. The SOFTWARE PRODUCT is not for resale. 
3.2	Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT.
3.3	Trademarks. This EULA does not grant you any rights in connection with any trademarks or service marks of March Hare Pty Ltd.
3.4	Termination. Without prejudice to any other rights, March Hare Pty Ltd may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
3.5     Beta Test software. Software that has been made available through the Beta Test project is not generally available software. It has not undergone complete testing and may contain errors. It may not function properly and is subject to change or withdrawal at any time. No support or maintenance is provided with the Software. Do not install this software if you are not accustomed to using experimental software. 

4.	COPYRIGHT. All title and intellectual property rights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by March Hare Pty Ltd or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by March Hare Pty Ltd.

MISCELLANEOUS
If this product was acquired outside Australia, then local law may apply.

LIMITED WARRANTY
March Hare Pty Ltd agrees to supply one (1) months support for the SOFTWARE PRODUCT in it's original purchase form.  Any changes made to the software subsequent to purchase are not in any way included in this support agreement. 

NO OTHER WARRANTIES.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, March Hare Pty Ltd AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE PRODUCT, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. 
LIMITATION OF LIABILITY.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL March Hare Pty Ltd OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF March Hare Pty Ltd HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, March Hare Pty Ltd's ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT OR U.S.$5.00; PROVIDED.
